The European Data Protection Supervisor oversees relevant AI systems used by EU institutions and agencies. Penalties for non-compliance may include fines up to 15 million euros, or 3% of a company’s global annual turnover. Smaller businesses may face lower maximum fines if the calculation results in a lesser penalty. The regulation provides a phased transition for generative AI systems launched before August 2, 2026, granting providers until December 2, 2026, to implement machine-readable markings. This extension applies solely to the technical marking requirement and does not delay notices related to interactive AI, deepfake disclosures, or public-interest content rules. Additionally, content produced prior to the transparency regulations are not subject to retroactive labeling.
